Skilloverse Privacy Policy

  1. Your privacy and the protection of your (user of Modimido's Skilloverse service) data is very important to us, Modimido UG (haftungsbeschränkt) (hereafter: Modimido), including our management personnel. This document informs you of your rights, how we process and use your data, and other items in accordance with the General Data Protection Regulation (GDPR).
  2. Skilloverse is an online service offered by Modimido.
  3. Although we implement various measures to ensure the protection of your personal data, it is not possible to guarantee its protection since Internet communication may have security flaws generally.
  4. It is possible to view web pages made available by Modimido without any indication of your personal data besides your IP address. However, to use the Skilloverse service, processing of personal data is necessary as described in this document. You voluntarily provide your data or we obtain your consent for all the data personal data we collect from you where there is no statutory basis for processing such data.

  6. Use of cookies and similar technologies
    1. By default, this website does not use cookies or similar technologies when accessed publicly.
    2. If you create an account and log in, we use a technology called local storage which is similar to cookies to store data in your browser which is then used to authenticate your requests to Skilloverse servers. Without this authentication mechanism, it would not be possible to use Skilloverse. The name of the data item stored is ‘user-state’. It contains a token used as part of authenticating and authorising your requests to Skilloverse servers. This value is stored in the browser indefinitely and is deleted when you log out of Skilloverse or clean your browser history. Although it may be stored indefinitely, it expires 7 days after it was issued if it is not refreshed in this period and will not be able to authenticate requests after it expires.
  7. Data processing and its purpose
    1. Collection of personal data when visiting publicly accessible websites
      1. In order to monitor and secure our systems, we may collect information such as IP address, browser type and browser version, operating system, referrer URL, hostname of the device connecting to our services, and the time of the request. This data is not merged with any other data and is used only for the purpose of ensuring network and information security (legal basis is Art. 6 para 1 sentence 1 lit. f GDPR).
      2. Apart from the data noted in the previous point, it is possible to access the public parts of Skilloverse without any further data being processed. The points in 7.b refer to data collected when you choose to create an account with Skilloverse (legal basis for mandatory data is Art. 6 para 1 sentence 1 lit. b GDPR; legal basis for optional data provided by Modimido user is Art. 6 para 1 sentence 1 lit. f GDPR).
    2. Collection of personal data when using Skilloverse services
      1. Your name is used to help facilitate communication and valid business transactions.
      2. Your email address is used to help secure your account, communicate with you about activity related to your account, and communicate other material with you depending the preferences you have set in the Skilloverse settings.
      3. When you make a payment, we receive some necessary details related to the payment. We use PayPal (Europe) S.à.r.l. et Cie, S.C.A as payment provider. For the payment process request to PayPal, your browser will send you IP address to PayPal. We do not provide your data to PayPal.
      4. To determine which business users and freelance users seem relevant to one another, information from both parties must be collected. This information is optional; although, at least one unit of this information must be provided by a user in order to suggest relevant matches for that user. This information may include, but is not limited to, data such as: country, state, language, communication preferences, availability, industry, industry experience, technologies and systems used, skill set, as well as an open text introduction. This data is used to match users. That is, if a business and freelancer have lots of common data items, they are probably more likely to find one another using the Skilloverse service. At first, this information is only presented to other users in a pseudonymous form if you have chosen to write it in this way; that is, without indication of name or other personal identifiable information. Names will only be revealed between two users once both users agree to communicate; for example, once a business user has invited a freelancer user to chat and the freelancer user accepts the invite.
    3. We may also use your information to provide you support, if you request it.
    4. The use of the Skilloverse service is voluntary, we only process the data voluntarily provided to match users together. Although, at least one unit of information must be provided by a user in order to suggest relevant matches for that user.
    5. We do not sell your data to third parties.
  8. How data is collected
    Personal data may be collected when you send us data using one of the forms on our websites, when you send us an email, when you send us a message via the telephone, or when you write us a letter.
  9. Recipients of the data
    1. Your professional profile as described in 7.b.iv (which may be pseudonymous if you choose not to provide identifying information) can be seen by other users of the Skilloverse service.
    2. Your name can be seen by other users of the Skilloverse service you who agree to communicate with.

  10. Third countries
    1. Users may sign up to Skilloverse from countries outside the EU and countries recognised by the EU as having adequate privacy protections. Necessarily, communicating with users in third countries means data may be transferred to countries not recognised as secure by the EU. Such communication occurs over encrypted channels and users in third countries are likewise bound by these terms and the Skilloverse service terms of use to protect the data of other users of the Skilloverse service.
    2. Except as outlined in the previous point, the processing of your data does not involve transmission to countries outside the EU.
  11. Third parties
    1. When paying by PayPal, your payment details are shared with PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxemburg. PayPal processes data in accordance with its Privacy Policy which can be found here:

    2. A connection is only made with PayPal servers when you indicate that you would like to use PayPal. It is possible to make a payment with PayPal without creating a PayPal account.
  12. Data retention periods
    1. Information collected for the purpose of monitoring and securing our systems is retained for 60 days or less.
    2. Information collected in connection with your user profile is stored for two years since your last interaction with the Skilloverse service or until 14 days after you request the deletion of your data except in cases where we are legally required to retain the data for a longer period; for example, for financial transaction records. The data deletion process is described in section 13.c.
  13. Your rights
    In accordance with GDPR, this document informs you of your rights when it comes to data protection. This section outlines your rights to: access your data, rectify your data, erase your data restrict your data, data portability and object.
    1. You have a right to access your data. This can be done by logging in to the Skilloverse service. If you have difficulties, please write an email to us at data@modimido.tech using the same email address you used when providing your data with the subject ‘Data access request’. We may reply asking an additional verification question to ensure it really is you. Once your identity is verified, we will reply within 7 days with a guide on how to access your data via account settings in the Skilloverse service.
    2. You have a right to rectify your data. This can be done by logging into the Skilloverse service and editing your profile. If you have difficulties, please write an email to us at data@modimido.tech using the same email address you used when providing your data with the subject ‘Data update request’ and, in the body of the email, describe what you would like rectified. We may reply asking an additional verification question to ensure it really is you. Once your identity is verified, we will rectify your data and reply within 7 days.
    3. You have a right to erase your data. This can be done by deleting your Skilloverse account via the settings page. If you have difficulties, please write an email to us at data@modimido.tech using the same email address you used when providing your data with the subject ‘Data deletion request’. We may reply asking an additional verification question to ensure it really is you. Once your identity is verified, we will delete all your data within 14 days.
      1. We may be legally required to retain some data, for example data related to financial transactions.
      2. If you have paid for access to the Skilloverse service, your access to the Skilloverse service will also be irrevocably terminated when you delete your account (for details, including about refunds, see Skilloverse’s terms and conditions: https://www.skilloverse.com/terms).
    4. You have a right to restrict your data. Please write us at data@modimido.tech using the same email address you used when providing your data with the subject ‘Data restrict request’. We may reply asking an additional verification question to ensure it really is you. Once your identity is verified, we will restrict your data within 7 days.
    5. You have a right to data portability. Please write an email to us at data@modimido.tech using the same email address you used when providing your data with the subject ‘Data portability request’. We may reply asking an additional verification question to ensure it really is you. Once your identity is verified, we will send you your data in JSON format within 14 days.
    6. You have a right to object. Please write us at data@modimido.tech using the same email address you used when providing your data with the subject ‘Data object request’. We may reply asking an additional verification question to ensure it really is you. Once your identity is verified, we will examine your right to object and if applicable, we will no longer process your data.
  14. Complaints You have the right to lodge a complaint with a supervisory authority.

  15. Algorithmic processing
    1. No decisions are made solely on the basis of algorithmic processing.
    2. A search engine is used to identity freelancer users and business users who appear relevant to one another. This means that, for a project posted by a business user, those freelancer users whose profile content appears most relevant to the business user's profile content and project content will tend to appear more prominently in the search results. The decision of whether to then enter into communication lies with the users.
    3. Users have control over the content used in the way described by the previous paragraph as described in the 'Your Rights' section.
